Coordinated Defense

 

Most medical professional litigation involves multiple defendants ranging from other physicians, professional corporations, allied health care providers and hospitals. Traditionally, the aforementioned parties will be individually represented by an attorney whose strategy involves alleging negligence on the part of another defendant. This scenario favors the plaintiff.

 

We believe that a proactive approach with other defendants can reduce costs and benefit the defendant, without jeopardizing the interests of the insured. As an example, we can and do share the cost of expert witness fees with other defendants. In some instances we have been able to share an attorney who represented more than one defendant when feasible and ethically permissible. This approach works well in cases that are pursued through alternative dispute resolution, a method we frequently use.
